§ 13-1. State statutes adopted by reference.

  • (a)

    The following statutes of the state, as they currently exist and as they may be amended from time to time, are hereby adopted and made ordinances of the city. Violations of said state statutes shall constitute violations of ordinances of the city, and the interpretation, application, enforcement and administration of said state statutes shall be identical with respect to the city as they are interpreted, applied, enforced and administered by the state, through its judicial and executive departments, to wit:

    (b)

    For the purposes of this section, any reference to the state, its branches, departments or agencies, shall include the city and all of its departments and functions, and any references to highways shall include also the city streets.

    (c)

    Violations of any of the statutes enumerated in this section shall be charged as violations of the provisions of this section, and reference to the applicable state statutes need not be made. However, the provisions of the applicable state statute shall be set forth to the same extent required by the laws of this state for the purpose of informing a defendant of the offense with which he is charged. The provisions of said statutes are made a part of this section as fully as if copied herein in extenso, as they may be amended from time to time.

    (d)

    Notwithstanding the provisions for maximum punishment by the various statutes heretofore enumerated, the maximum punishment for violations thereof shall be as set forth in section 1-5 of this Code.

    (e)

    The adoption of the state statutes heretofore enumerated as city ordinances shall not act to repeal any ordinance of the city, and where applicable an offense may be charged either as a violation of a specific ordinance of the city, or as a violation of this section.
