§ 5-6. Moving buildings.

  • (a)

    Permits required.

    (1)

    The moving of houses, buildings and other constructions on, over and through the streets and alleys of the city is hereby declared to be a nuisance and is prohibited unless a permit is first obtained and the provisions of this section complied with.

    (2)

    The owner shall, at the time of filing said application therefore, pay to the director of revenue, regulatory codes and permits a fee, including a fee for inspection and supervision of disconnection of all utilities, as may be fixed from time to time by the city council.

    (b)

    Application; fee deposit. Any contractor or other person desiring to move any house, building or construction over, on or through any of the streets or alleys of the city shall first make application to the director of revenue, regulatory codes and permits for a permit, which application shall be in writing, describing the character of the construction or building to be moved, the exact distance and the streets or alleys over which its is to be moved. A permit fee fixed from time to time by the city council shall be charged the applicant, payable in advance; in addition thereto, the applicant shall be assessed and pay in advance as estimate made by the city secretary-treasurer for the costs and expenses incurred by the city for its supervision, inspection and assistance for street and wire clearances.

    (c)

    Bond. Any contractor or other person making application for a permit under this section shall at the time of making application for said permit file with the mayor a bond in a sum fixed by the city council from time to time, signed by a surety company duly authorized to do business in the state, or by good and solvent sureties owning property in the city, which bond shall guarantee to protect the city against any damage to any streets, sidewalks or other property belonging to the city or to the public.

    (d)

    Supervision. When any permit is issued to any contractor or other person for the moving of any house, building or construction over any streets or alleys of the city, the moving of said building or construction shall be conducted under the regulation and supervision of the chief of police and subject to his direction with regards to the streets to be used and the traffic thereon. Prior to delivery of the building to its new location it shall be subject to building code and ordinance enforcement by the building code enforcement officer.
