§ 16-27. Work to be prompt; backfilling; protection of public; liability for damages.

  • (a)

    Any cut on any street made by any person under the provisions of this article shall be made promptly after the permit is taken out and shall be backfilled without any delay as soon as the work is completed. All trenches shall be back-filled in layers not over six (6) inches thick, thoroughly compacted by tamping. In the event more than one (1) person is engaged in this operation, there shall not be less than one (1) person tamping to each person shoveling earth backfill in the trench, and such person shall protect such cut while making same and doing any work thereon. All liability for any damages accruing from such cut and while such work and refilling are being done shall be the responsibility of the person obtaining the permit and doing the work.

    (b)

    The person obtaining such permit and doing such work shall notify the city when ready to begin backfilling, so that inspection can be called for. The person shall keep and maintain such trench and backfill to grade and in good condition in order to afford the least possible obstruction to traffic for a period of thirty (30) days after such backfill has been completed.

    (c)

    The cost of repaving the street, curbing, and sidewalk shall be borne by the permit hold to the specifications of the city.
