§ 13-48. A.A. Comeaux Park and other parks generally.

(a)

(1)

A.A. Comeaux Park shall be open to the public daily between the hours of 8:00 a.m. and 11:00 p.m., and otherwise only on dates and times specifically authorized by the city council. It shall be unlawful for any unauthorized person to enter into or to remain upon any part of the grounds or enclosures of said parks during any times not designated in this subsection.

(2)

The baseball field at Williams Park, and the basketball courts at McKinley-Scott Park shall be open to the public daily between the hours of 8:00 a.m. and 8:00 p.m. Central Standard Time, or 8:00 a.m. and 10:00 p.m. Daylight Savings Time and otherwise only on dates and times specifically authorized by the city council. It shall be unlawful for any unauthorized person to enter into or to remain upon any part of the grounds or enclosures of said parks during any times not designated in this subsection.

(b)

All other parks which are now or may hereafter be located and established within the city limits, the non-baseball field portion of Williams Park, and the non-basketball courts portion of McKinley-Scott Park shall be open to the public daily between the hours of 8:00 a.m. and 8:00 p.m. during daylight savings time, and between the hours of 8:00 a.m. and 6:00 p.m. otherwise, except at such other times specifically authorized by the city council. It shall be unlawful for any unauthorized person to enter into or to remain upon any part of the grounds or enclosures of said parks during any times not designated in this subsection.

(c)

All ballparks located in any park owned by the city are hereby designated as "smoke free facilities." As such no one may smoke any tobacco product inside the ballpark. For these purposes "ballpark" shall include the entire area with the exterior fences of the facility, including, but not limited to the playing field, the grandstands, concession areas, and all walkways contained therein. With the exception of the Theriot-Palombo Complex, there are hereby created "smoking permitted zones" outside the exterior fences of the ballparks as designated by the recreation board. The "smoking permitted zone" for the Theriot-Palombo Complex shall be designated by the recreation board within the exterior fences.

(d)

The provisions of this section shall not apply to F. Godchaux Park.

(e)

Whosoever violates subsections (a) and/or (b) of this section shall be subject to a fine of not less than twenty-five dollars ($25.00) nor more than fifty dollars ($50.00), for a first offense, or not less than fifty dollars ($50.00) nor more than one hundred dollars ($100.00), for all subsequent offenses, together with all cost incidental thereto.
