§ 12-92. Definitions.

  • [As used in this article the following definitions shall apply:]

    Antique vehicle means any motor vehicle twenty-five (25) years or older, which is operable and substantially in its original condition. These vehicles must be registered as antiques and display an antique license plate.

    Abandoned motor vehicle means a motor vehicle that is inoperable and is left unattended on public property for more than three (3) days, or is inoperable and left unattended on the shoulder or right-of-way of a road, street or alley within the corporate limits of the city for more than three (3) days, or a motor vehicle that has remained illegally on public property for a period of more than three (3) days, or a motor vehicle that has remained on private property without the consent of the owner or person in control of the property for more than three (3) days.

    Junked motor vehicle means any motor vehicle which is inoperable due to a condition of having an essential element necessary for self-propulsion missing or damaged beyond repair, or damaged to the point where the vehicle is incapable of passing the inspection required by R.S. 32:1301, et seq. Any operable or inoperable motor vehicle which is ten (10) years old or older, in such a state of deterioration that it cannot be profitably restored and has a fair market value of five hundred dollars ($500.00) or less. Any operable vehicle which does not have lawfully affixed thereto both an unexpired license plate and a valid motor vehicle inspection tag shall be presumed to be a junked vehicle unless its owner shall produce proof that the same has been immobilized due to a lack of insurance, or has been converted to a special off road use including but not limited to racing and antique collection purposes.

    Motor vehicle means any self-propelled vehicle including every device in, upon, or by which any person or property is or may be transported or drawn upon a street, roadway, highway, or waterway, including but not limited to automobiles, trucks, buses, motorcycles, motorbikes, motor scooters, tractors, go-carts, motorhomes, boats, motors, and trailers. For the purposes of this section, motor vehicles shall also include mobile homes, campers and/or travel trailers which have not been immobilized by declaration filed with the Vermilion Parish Clerk of Court.

    Owner of the premises means the owner of the land upon which the vehicle is located, as shown on the last assessment roll or a real or juridical person having possession thereof under a grant of authority from the owner as shown on the last assessment roll.

    Owner of the vehicle means the last registered owner as indicated by the Louisiana Department of Motor Vehicles, or other foreign agency.
