§ 12-1. Highway regulatory act adopted.

  • (a)

    Pursuant to the authority conferred by R.S. 32:41(C), the city hereby adopts the provisions of Louisiana Revised Statutes, title 32, chapter 1, the Louisiana Highway Regulatory Act, and all regulations of the State Departments of Highways, Transportation and Public Safety which have been or which may be adopted pursuant thereto, together with all supplements, amendments and revisions to same as they may happen in the future without the necessity of amending this article, except such provisions or regulations as by their nature can have no application and except as otherwise provided in this Code. The first violation of the provisions of the section shall be punished by a fine of not more than one hundred seventy-five dollars ($175.00) or by imprisonment for not more than thirty (30) days, or both. A subsequent violation shall be punished by a fine of not more than five hundred dollars ($500.00) or by imprisonment for not more than sixty (60) days, or both.

    (b)

    For the purposes of this section, any reference to the state, its branches, departments or agencies shall include the city and all of its departments and functions, and any references to highways shall include also the city streets. Violations of any of the statutes contained in Title 32 shall be charged as violations of this section of the Code of Ordinances and reference to the applicable state statutes need not be made. However, the provisions of the applicable state statutes shall be set forth to the same extent required by the laws of this state for the purpose of informing a defendant of the offense with which he is charged. The provisions of the statutes are made a part of this section as fully as if copied herein in extenso, as they be amended from time to time.
