§ 10-31. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Door-to-door vendor means all persons, firms and corporations, as well as their agents and employees, who engage in the temporary or transient business in the city of selling or offering for sale any goods or merchandise, or exhibiting the same for sale, or exhibiting the same for the purpose of taking orders for the sale thereof; and who for the purpose of carrying on such business or conducting such exhibits thereof do not hire, rent, lease, occupy or receive by donation any room or space in any building, structure or other enclosure, or on any lot in the city in, through or from which any goods or merchandise may be sold, offered for sale, exhibited for sale or exhibited for the purpose of taking orders for the sale thereof. Street and sidewalk vendors are also included in the meaning of this terms.

    Itinerant vendor means all persons, firms and corporations, as well as their agents and employees, who engage in the temporary or transient business in the city of selling or offering for sale any goods or merchandise, or exhibiting the same for sale, or exhibiting the same for the purpose of taking orders for the sale thereof; and who for the purpose of carrying on such business or conducting such exhibits thereof either hire, rent, lease, occupy or receive by donation any room or space in any building, structure or other enclosure, or on any lot in the city in, through or from which any goods or merchandise may be sold, offered for sale, exhibited for sale or exhibited for the purpose of taking orders for the sale thereof.

    Mobile food truck means a vehicle that is completely mobile with no permanent fixed location, the vendor of which prepares all or most of its victuals on board the vehicle to serve or distribute to customers, (such preparation to be in conformity with all requirements of the state department of health and hospitals, or its successor), in a form suitable for immediate ingestion and consumption. This definition excludes vendors who are selling the following foodstuffs directly to customers from motor vehicles: fresh, uncooked or unprepared produce or seafood, or farmers selling their own produce or value-added products (including, but not limited to oils, jams, jellies), or "traditional ice cream trucks," as hereinafter defined. Permitting and regulation of mobile food trucks is more fully set forth in section 10-52 et seq.

    Temporary means any business described in this section transacted or conducted in the city for which definite arrangements have not been made for hire, rental or lease of premises for at least six (6) months in or upon which such business is to be operated or conducted.

    Traditional ice cream truck means a motorized vehicle which dispenses packaged single serving frozen treats while making frequent stops in residential neighborhoods, and is thus distinguished from a food truck because food is not prepared therein, and it does not become stationary for more than a few minutes at a time.

    Transient means any such business of any itinerant vendor and door-to-door vendor as may be operated or conducted by persons, firms or corporations or by their agents or employees who reside away from the city, or who move stocks or goods or merchandise or samples thereof into the city with the purpose or intention of removing them or the unsold portion thereof away from the city before the expiration of six (6) months.
